The French Planning Portal (Géoportail de l'urbanisme) allows you to consult your municipality's Local Urban Development Plan (PLU) online. It provides information on zoning, building heights, maximum footprint, setback requirements and any public easements affecting the property.

Please note: the former Land Occupancy Coefficient (COS) was abolished by the ALUR Act in 2014. However, the planning rules set out in the PLU—including building dimensions and positioning—still apply and may limit the size of the building plot that can be created.

You may also apply to your local authority for a planning certificate (either an information certificate or an operational certificate). This document is free of charge, usually issued within one to two months, and freezes the applicable planning rules for 18 months, helping protect your project against future planning changes.

The land subdivision procedure

The required administrative process depends on the number of plots being created and the location of the land.

Prior declaration

A prior declaration is generally sufficient to create one or two building plots, provided the land is not located within a protected area, no new roads or shared infrastructure are created, and the new plot has direct access to a public road.

The application is normally processed within one month.

Development permit

A development permit becomes mandatory if:

  • three or more building plots are created over a ten-year period;
  • new roads or shared facilities are required; or
  • the land is located within a protected area (such as near a listed monument or within a protected heritage site), regardless of the number of plots.

The processing time is generally three months, or up to four months in protected areas.

Land survey

A licensed land surveyor plays a key role whenever a building plot is created. They precisely establish the new property boundaries and prepare the cadastral documentation required to update the French land registry.

Capital gains tax when selling part of your land

For private individuals, selling part of a property is subject to the French capital gains tax regime.

The gain is taxed at:

  • 19% income tax, plus
  • 17.2% social contributions,

resulting in a combined tax rate of 36.2%.

Tax relief increases according to the length of ownership:

  • income tax is fully exempt after 22 years;
  • social contributions become fully exempt after 30 years.

Additional tax on building land

A specific additional tax may apply when selling undeveloped land that has recently become buildable following a change to the Local Urban Development Plan or local zoning regulations.

This optional municipal tax may reach 10% of the capital gain, and may be supplemented by a national tax.

It generally applies to land designated as buildable after 13 January 2010, and should be verified with your notary on a case-by-case basis.

A straightforward boundary survey generally costs between €600 and €1,000 (including VAT).

A complete land subdivision (boundary survey, cadastral amendments and plans) may cost between €3,000 and €7,500, depending on the complexity of the project.

Notary

As with any property sale, notary fees generally represent around 6% to 9% of the sale price.

Development tax

The development tax is payable by the future purchaser who builds on the newly created plot.

It is calculated using a nationally defined value per square metre, combined with municipal and departmental tax rates.

Overall timeframe

Expect the entire process—from planning checks and surveying to administrative approval and completion before the notary—to take between three and six months, although projects in protected areas often require more time.

Precautions to take before selling part of your land

  • Ensure the new plot has direct access to a public road. If not, a right-of-way easement will need to be created over the land you retain, which may affect its value and future use.
  • Anticipate utility connections, including water, electricity, drainage, gas and telecommunications. Responsibility for these costs should be negotiated with the purchaser.
  • Consider how the subdivision will affect your remaining property, including reduced privacy, overlooking from future buildings and any possible reduction in value.
  • Declare any existing easements (such as underground utilities, rights of way or rights to light) when selling the land, as failing to do so may result in claims for latent defects.
